Terms of service
The terms that apply when customers and users access Noice.work.
1. Agreement to these terms
These terms are an agreement between Noice Pty Ltd (ABN 91 634 536 360) and the person or organisation using Noice.work. By creating an account, accepting an order or using the service, you agree to these terms and the Privacy policy.
If you use Noice.work for an organisation, you confirm that you have authority to accept these terms for it. Any signed order, proposal or separate agreement with Noice also applies. If it conflicts with these online terms, the signed agreement takes priority to the extent of the conflict.
2. The service
Noice.work is a hosted platform for creating, managing and publishing websites, structured content and media. It includes authoring, brand and design-system controls, content libraries, forms, search, automation, APIs and optional AI-assisted features. Features can depend on the customer's plan, configuration and connected services.
We may improve, replace or discontinue features. We will take reasonable steps to avoid materially reducing paid core functionality during a current subscription, except where a change is needed for security, law, third-party availability or safe operation.
3. Accounts and eligibility
You must be at least 18 years old and legally able to enter a contract. You must provide accurate account information, keep credentials secure, use multi-factor authentication when required, and tell us promptly about suspected unauthorised access. You are responsible for activity performed through accounts you authorise.
Organisation owners and administrators control membership, permissions, sites and connected services. You must not use another person's account or share credentials in a way that bypasses those controls.
4. Acceptable use
You may use Noice.work only for lawful business purposes. You must not:
- upload or publish content you do not have the right to use, or use the service to infringe another person's rights;
- submit personal, confidential or regulated information without the authority and safeguards needed to process it;
- introduce malware, probe for vulnerabilities, evade access controls, or disrupt the service or another customer's site;
- use abusive automation, scraping or request volumes that unreasonably interfere with the service;
- misrepresent AI-generated material as verified where that could harm another person; or
- use the service for unlawful, fraudulent, deceptive, harmful or discriminatory activity.
We may investigate suspected misuse and limit access where reasonably necessary to protect customers, the service or others.
5. Customer content
You keep ownership of the content, data, files, designs, brands and other material you or your users provide to Noice.work. You are responsible for its legality, accuracy, permissions and backups.
You give Noice a non-exclusive licence to host, copy, transform, display, transmit and otherwise process customer content only as needed to provide, secure and support the service, follow your instructions, and comply with law. This includes sending the relevant content to a configured provider when an authorised user requests an AI, knowledge, voice or media feature.
You are responsible for notices and consents for personal information collected through your sites and forms. Noice's Privacy policy explains our own handling of personal information.
6. Noice intellectual property
Noice and its licensors own Noice.work, including its software, interfaces, documentation, design systems, methods and branding, excluding customer content. These terms give you a limited, non-exclusive and non-transferable right to use the service during your subscription; they do not transfer ownership of the platform.
You may give us feedback. If you do, you allow us to use it without restriction or payment, provided we do not identify you or disclose your confidential information in doing so.
7. AI-generated output
Noice.work can use artificial intelligence to draft pages, text, images, audio, video, code-like configuration and other output. AI output can be incomplete, inaccurate, unsuitable, biased or similar to material generated for someone else. It is not professional, legal or factual advice.
You must review and approve output before relying on or publishing it, and confirm that you have the rights and permissions needed for its intended use. Noice does not promise that output is unique, error-free or non-infringing. Your ownership and use rights in output are subject to applicable law and any terms that apply to the model or media provider used for the requested feature.
8. Fees, plans and metered credits
You must pay the fees, taxes and usage charges shown in your order, checkout or plan. Billing frequency, included usage, renewal and payment dates are the terms presented when you purchase or renew the service.
Some operations, including media generation, use metered credits. Credits are service-usage units, not money or a stored-value facility. The service can show a cost or require approval before a token-costing generation runs. A plan may limit or stop an operation when its available allowance is exhausted. Unless a signed agreement says otherwise, unused allowances do not create a cash entitlement.
Please contact us promptly about a billing error. We may suspend paid features for overdue amounts after reasonable notice, subject to any rights that cannot be excluded under law.
9. Availability and support
We aim to operate Noice.work reliably, but do not promise uninterrupted or error-free availability. Maintenance, security work, internet conditions and third-party services can affect it. Any service level, support hours, response commitment or remedy applies only if it appears in a signed agreement or the plan you purchased.
You are responsible for keeping an appropriate copy of important customer content and for testing material before a high-impact publication or migration.
10. Third-party services
Noice.work can connect to external hosting, identity, AI, knowledge, analytics, voice, media and other services. Their availability and output are outside Noice's direct control, and their own terms may apply. You authorise us to send the information needed to a connected service when you or an authorised user chooses the relevant feature.
11. Warranties and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy under the Australian Consumer Law or another law that cannot lawfully be excluded.
Subject to those non-excludable rights and any express promise in a signed agreement, Noice.work is provided “as is” and “as available”. We do not warrant that every feature or AI-generated output will be uninterrupted, error-free, accurate, complete, unique or fit for your particular purpose.
12. Liability
To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special or consequential loss, or loss of profit, revenue, goodwill or anticipated savings, arising from the service.
To the maximum extent permitted by law, Noice's total liability arising out of or relating to the service and these terms is limited to the amount you paid Noice for the service in the 12 months before the event giving rise to the claim. This limit does not apply to liability that cannot lawfully be limited.
You are responsible for claims arising from customer content, your unlawful use of the service, or your infringement of another person's rights, except to the extent the claim was caused by Noice.
13. Suspension and termination
You may stop using the service or end a subscription as allowed by your plan or signed agreement. Fees already incurred remain payable.
We may suspend or terminate access where you materially breach these terms, do not pay an overdue amount after reasonable notice, create a security or legal risk, or use the service in a way that could harm another customer, Noice or a third party. Where practical, we will give notice and an opportunity to fix the issue.
When access ends, your right to use the service ends. Data export and deletion are handled under the applicable plan, signed agreement, customer controls and our Privacy policy. Sections that by their nature need to continue—including ownership, payment obligations, disclaimers, liability and governing law—survive termination.
14. Changes to these terms
We may update these terms to reflect changes to the service, providers or law. We will update the date at the top of this page and give reasonable notice of a material change that adversely affects current paid use. Changes do not take away rights that have already accrued.
15. General
Neither party is responsible for delay caused by events beyond its reasonable control. If part of these terms is unenforceable, the rest continues. A failure to enforce a term is not a waiver. You may not assign these terms without our consent; Noice may assign them as part of a restructure, financing or sale of its business, subject to applicable law.
These terms and any signed agreement are the entire agreement about Noice.work and replace earlier discussions about the same subject.
16. Governing law and contact
These terms are governed by the laws of Victoria, Australia. The courts of Victoria have jurisdiction, subject to any right you have to bring a claim elsewhere under a law that cannot be excluded.
